How trademark registration works in Panama

You search availability, choose your Nice classes, file the application, pay the fees, DIGERPI examines the application, it is published for two months of oppositions and, if none succeed, your mark is registered.

A trademark application goes through a formal review, a substantive review and a public opposition period before it is registered. The opposition period lasts two months from publication, and only then is the certificate issued. Registration lasts ten years and can be renewed for further ten-year terms.

  1. 1

    Search availability

Check whether a similar mark already exists. DIGERPI offers a free online search; a professional search goes further.

  2. 2

    Identify your classes

Marks are registered by class under the international Nice Classification. List clearly the goods or services you want to protect.

  3. 3

    File the application

Complete DIGERPI’s application form with the mark, the owner and the goods or services.

  4. 4

    Pay the official fees

In person at Banco Nacional or through online banking, and attach the payment receipt.

  5. 5

    Examination

DIGERPI examines the application as to form and substance.

  6. 6

    Publication and oppositions

If the application is in order, it is published in the Official Industrial Property Bulletin, and third parties have two months, from the day after publication, to oppose.

Oppositions are argued before the commercial courts.

  7. 7

    Registration

If there is no opposition, or it is resolved in your favor, DIGERPI registers the mark and issues your registration certificate.

Corrections DIGERPI asks for most often

  • The name of the mark must match the label. If the logo contains a word, that word goes in the name; anything you do not want to protect is declared as not claimed.
  • A mark with words and a design is filed as “NAME AND DESIGN”.
  • Names and addresses must be identical in the application, the power of attorney and the sworn statement.
  • The label must not show the ® symbol before the mark is registered.
  • A copy of the power of attorney must be authenticated with a fresh seal; the original does not need legalization.
